GENERAL TERMS AND CONDITIONS
moobil+ terms of use and general rules
This document sets out the terms of use for the moobil+ internet platform, the moobil+ mobility centre and the moobil+ card, as well as general rules on the registration of moobil+ users and the exclusion of individuals from moobil+:
- With the moobil+ internet platform at “www.moobilplus.de”, the districts of Vechta and Cloppenburg are providing an internet application on which journey requests on moobil+ routes can be registered and confirmed.
- Further, the districts of Vechta and Cloppenburg provide an office that can be contacted by telephone or in person (“mobility centre”), which provides information about moobil+ journeys during office hours in person or on the phone, advises on the implementation of various activities relating to moobil+ and receives and confirms journey requests on moobil+ routes.
- Use of the moobil+ internet platform and mobility centre is free of charge. This naturally does not apply to the operation of a connection to use the internet and the use of the telephone. Telecommunication costs may be incurred here which are not in the areas of responsibility of the districts of Vechta and Cloppenburg.
- There shall be no claim to use of the moobil+ internet platform and the mobility centre. The districts of Vechta and Cloppenburg reserve the right to introduce a temporary restriction to their services for reasons relating to system utilisation, the integrity and security of the moobil+ internet platform and the mobility centre or the implementation of necessary maintenance work.
- Users of moobil+ must not manipulate or copy the moobil+ internet platform or parts thereof and
- must not impair the functionality of the internet platform,
- must not use it for content which is pornographic, endangers children, is anti-constitutional, glorifies violence, is racist or use it for any other content that violates the law or good morals or contradicts the concept of passenger transportation with moobil+,
- must not use it to disseminate unsolicited mass messages, carry out advertising, send chain letters or similar to other users or offer them products or services.
- Users of the moobil+ internet platform and mobility centre may
- not deliberately provide any incorrect or misleading information or register using a fake identity,
- not insult, slander or defame, harass or cause harm to other users in any way.
- Passengers may pay their travel costs on a cashless basis if they have already registered. The moobil+ tariff provisions provide details on cashless payment.
- There shall be no claim to registration. The districts of Vechta and Cloppenburg are entitled to refuse registration to users without providing any reasons for this.
- Any one natural person may only register as a moobil+ user once.
- The registration can be carried out by the moobil+ user via the moobil+ internet platform or via the mobility centre.
- The moobil+ user needs to have a valid email address to register on the moobil+ internet platform.
- As part of the registration process, moobil+ users provide data that is required for subsequent cashless payment of travel costs for moobil+ journeys. Furthermore, additional details can be provided on a voluntary basis which are marked as optional and enable further services to be provided by the districts of Vechta and Cloppenburg
- Users of moobil+ who wish to register on the moobil+ internet platform set up a username of their choice and a personal password as part of the registration process to protect their personal data.
- The moobil+ users are responsible for the confidential handling of their username and password. In particular, they have sole responsibility for all use and all activities using their username or password, including use of the username or password by third parties. They undertake to inform the districts of Vechta and Cloppenburg without undue delay about any unauthorised use or misuse of moobil+ in their name.
- After completing the registration process, every moobil+ user receives a moobil+ card which is sent to them in the post. Immediately after completing the registration process, they also have the option of printing a temporary moobil+ card.
- A moobil+ user can identify themselves using the moobil+ card when getting on a moobil+ bus and they can use the number on the card to register journey requests via the mobility centre.
- moobil+ users are responsible for the confidential handling of their moobil+, in particular the number on the card.
- moobil+ users have sole responsibility for all use and all activities using their moobil+ card, including the use of the details on the card by third parties.
- moobil+ users undertake to inform the districts of Vechta and Cloppenburg without undue delay about any unauthorised use or misuse of their moobil+ card.
- moobil+ users are obligated to get their card blocked by the mobility centre without undue delay to prevent misuse if they lose their card for any reason.
- The districts of Vechta and Cloppenburg guarantee compliance with statutory data protection regulations (on this, see also the separate data protection information for moobil+).
- We ask moobil+ users to always keep the information they provide up to date
- A moobil+ user can cancel their use of moobil+ at any time via the mobility centre. After cancellation and successful invoicing and/or after collection of any outstanding transport charges, the individual user data will be erased insofar as this is legally permissible.
- Users of the moobil+ internet platform and the mobility centre understand that the districts of Vechta and Cloppenburg are entitled to exclude them from further use of moobil+ and to erase their entries on the moobil+ internet platform in the event they do not comply with the rules set out here.
- In cases of misuse of the moobil+ internet platform or the mobility centre, the districts of Vechta and Cloppenburg reserve the right to inform the responsible (prosecution) authorities.
- The districts of Vechta and Cloppenburg reserve the right to amend the rules set out here on the use of the moobil+ internet platform and the mobility centre at any time. moobil+ users will be informed about this.
- The districts of Vechta and Cloppenburg also reserve the right to claim compensation for damages in the event of the misuse of the moobil+ internet platform or the mobility centre
